Article 1 (About these Terms)

These Terms set out how GunplaDex (the "Service") may be used and the promises between users and the operator (the "Operator"). By using the Service, you agree to these Terms.

The Service is for recording the Gunpla you own like a collection book and enjoying it. Photos are stored as reduced-size versions for display in your collection, and the Service cannot be used to keep your original photos.

Article 2 (An unofficial fan app)

The Service is an unofficial fan app made by an individual who loves Gunpla. It is not affiliated with, endorsed by, or sponsored by BANDAI SPIRITS Co., Ltd. (the maker and seller of Gunpla), Bandai Namco Filmworks Inc. (the rights holder of the Gundam works), or any related company.

"GUNPLA" (ガンプラ) and "GUNDAM" (ガンダム) are registered trademarks of Bandai Namco Filmworks Inc. in Japan. The Service uses these names only to identify kits. The Service does not use official box art, product images or images from the works.

Article 3 (Who can use the Service)

  1. You must be 13 or older (14 or older if you live in South Korea, following Google Account age rules). If you are under 18, please get your parent's or guardian's consent before using the Service.
  2. If we learn that a user is below the minimum age, we will treat the account as deleted.
  3. The Service is not available in the European Union (EU), the European Economic Area (EEA), the United Kingdom or Switzerland. If you nevertheless reach the Service from those regions (for example while travelling or through a VPN), we will handle account deletion and data requests through our normal procedures.

Article 4 (Accounts)

  1. You sign in with a Google Account. There is no password or email sign-in.
  2. Each user has only one sign-in method (we do not link multiple accounts).
  3. You must not let others use, or sell, your account.

Article 5 (Content you add)

  1. The rights to the photos, nickname and records you add (your "Content") remain yours.
  2. You allow the Operator to use your Content free of charge only as needed to provide the Service (storing, resizing and similar processing, displaying, reviewing, and creating collection books or share images). The Operator will not use your Content beyond this scope.
  3. Before storing a photo, the server rebuilds it and removes information such as where it was taken (location data).
  4. Please only add photos you took yourself. Photos taken by others, official box art or product images, and images copied from magazines or websites are not allowed.

Article 6 (Prohibited conduct)

You must not:

  1. break the law or public order and morals, or do anything connected with crime;
  2. infringe the copyright, portrait rights, privacy or other rights of others (including using other people's images);
  3. post photos showing faces, addresses, licence plates or anything else that identifies a person;
  4. advertise, solicit or sell, or lead people to other services;
  5. exchange contact details (email addresses, phone numbers, social media accounts, etc.) or use the Service to arrange meetings;
  6. pretend to be the Operator or an official party, or impersonate others;
  7. post offensive, violent or sexual content, or harass others;
  8. access the Service without permission, send excessive traffic, or disrupt it;
  9. do anything else similar to items 1 to 8 that causes a concrete problem for running the Service or for other users.

Article 7 (Suspension and removal)

If you break these Terms, or when urgent action is needed to protect the Service or other users, the Operator may hide or delete your Content or suspend your account without prior notice. Whenever possible, we will show you the reason.

Article 8 (Deleting your account)

  1. You can delete your account from My page at any time. Your records, photos, nickname and other data are then deleted step by step (see "How long we keep information" in the Privacy Policy).
  2. After you delete your account, you cannot sign up again with the same Google Account while the deletion is in progress and for 30 days after it is complete.

Article 9 (Changes, pauses and ending the Service)

The Operator may change, pause or end the Service. If the Service ends, we will let you know in advance whenever possible.

Article 10 (Limits of responsibility)

  1. The Operator works to keep the Service accurate and safe and to avoid losing data. However, we cannot promise that all kit information (such as prices and release years) is accurate or that the Service will always be available. The Service is not a storage service that promises to keep your photos or data; please keep the original photos on your own device. This paragraph does not remove the Operator's responsibility set out in paragraphs 2 and 3.
  2. If the Operator's intentional misconduct or gross negligence causes you damage, the Operator will compensate you as required by law.
  3. Only in cases of the Operator's slight negligence (negligence other than gross negligence), the Operator's liability is limited to ordinary damages you actually incurred, up to JPY 5,000. This limit does not apply to harm to your life or body.
  4. Please resolve disputes between users through discussion between the people involved. The Operator will take action under these Terms where needed (such as hiding Content). Where the Operator is at fault, the Operator's responsibility is as set out in paragraphs 2 and 3.

Article 11 (Changes to these Terms)

The Operator may change these Terms when necessary. When we do, we will announce in the Service, before the effective date, that the Terms will change, the new content, and the date the change takes effect.

Article 12 (Language, governing law and courts)

  1. The Japanese version of these Terms is the official version. English and other versions are translations for reference.
  2. These Terms are governed by the laws of Japan.
  3. Any dispute about the Service will be subject to the exclusive jurisdiction, in the first instance, of the district court with jurisdiction over the Operator's address.
